5A_631/2024: Non-admission of the appeal concerning precautionary measures in divorce proceedings
Summary of the Facts
The parties A.________ and B.________ were married from 1998 to 2017 with a traditional division of roles. The marriage produced three children, now of full age. The wife continues to live in the property solely owned by the husband. Disputes arose over the retroactive determination of spousal maintenance payments and the judicial clarification of precautionary measures in the divorce proceedings.
Summary of the Considerations
(1) Consolidation of proceedings: The two appeals 5A_631/2024 and 5A_643/2024 concern the same maintenance issues and are consolidated pursuant to Art. 71 BGG in conjunction with Art. 24 BZP. (2) Applicable legal framework: The contested decision is a cantonal final-instance ruling on precautionary measures pursuant to Art. 276 ZPO. According to Art. 98 BGG, only violations of constitutional rights may be alleged. Criticisms of a purely appellate nature are disregarded. (3) Maintenance calculation and duty to earn income: The disputed income of the wife was not hypothetically assumed by the Higher Court. This was deemed lawful because: - The wife exclusively took care of the household and children during the marriage. - A professional re-entry, e.g., as a lawyer, was considered practically impossible. - The marital division of tasks was consensually lived, enabling the husband to focus professionally and earn a high income. (4) Husband’s complaints: His allegations (e.g., that the wife should have exhausted her earning capacity during the separation period) were classified as appellate and unsubstantiated. Jurisprudence on Art. 163 ZGB allows an exception to the obligation to credit for fictitious income under exceptionally favorable financial circumstances. (5) Wife’s complaints: - The amount of the lump-sum base amount (six times the debt enforcement amount) was confirmed by the Higher Court without arbitrariness. A concrete quantification was not convincingly possible. - The allegation of incorrect consideration of previous maintenance payments was rejected since the wife did not submit quantified motions in the cantonal proceedings.
Summary of the Dispositive
The proceedings were consolidated and the appeals were dismissed. Costs were imposed on the parties equally, and each party bears its own costs.
9C_44/2026: Non-admission of the appeal concerning referral decision on disability insurance
Summary of the Facts
The IV Office Schaffhausen rejected the respondent’s claim to a disability pension by decision of 22 May 2024. The Higher Court of the Canton of Schaffhausen partially upheld the complaint on 16 December 2025, annulled the decision, and referred the matter back to the IV Office for further clarification of the medical facts. The IV Office appealed this referral decision to the Federal Supreme Court.
Summary of the Considerations
- **E.1:** The Federal Supreme Court establishes that referral decisions generally constitute interlocutory decisions. Final decisions exist only if the lower instance has no further discretion. This is not the case here, as the lower instance required further medical clarifications. - **E.2.1-2.2:** Interlocutory decisions are only independently appealable under the conditions of Art. 93 para. 1 BGG, especially if an irreparable disadvantage (lit. a) or considerable expense could be avoided by immediate approval (lit. b). These conditions are to be applied restrictively. - **E.2.3:** No irreparable disadvantage arises from the referral, which is undisputed. - **E.2.4:** An immediate approval of the appeal would not result in a final decision, as the referral requires further clarifications. Thus, Art. 93 para. 1 lit. b BGG does not apply either. - **E.2.5:** The appeal is inadmissible and insufficiently reasoned. Non-admission of the remedy occurs pursuant to Art. 108 para. 1 lit. a and b BGG.
Summary of the Dispositive
The appeal is not admitted, and the court costs as well as compensation are imposed on the appellant.
5A_175/2025: Non-admission of the appeal concerning maintenance contributions in matrimonial protection measures
Summary of the Facts
The spouses A.________ and B.________ separated in October 2022. The central dispute in the matrimonial protection measures concerns maintenance contributions. The cantonal single judge had ordered A.________ to pay her husband CHF 7,220 monthly. A.________ filed an appeal with the Federal Supreme Court requesting that no maintenance payments be owed.
Summary of the Considerations
The Federal Supreme Court declares the appeal admissible pursuant to Art. 72 et seq. BGG, as it relates to matrimonial protection measures. Only violations of constitutional rights are examined. The appellant must clearly and in detail specify how an arbitrary violation has occurred. Voluntary contributions from the appellant’s family were added to her income as they played a central role in the couple’s standard of living. This practice corresponds to established case law under which such contributions are creditable under certain circumstances. The assessment of the husband’s income and expenses was not successfully challenged, as it was not questioned before the lower court. The appeal argued that contributions to support an economically independent spouse were excessive. However, the Federal Supreme Court reaffirmed the principle of shared spousal support according to Art. 163 ZGB as long as the marriage exists. Additional allegations of alleged unfairness or supposed interference with the matrimonial property regime were rejected, as they lacked new legal content or were insufficiently reasoned.
Summary of the Dispositive
The appeal was dismissed and court costs as well as party compensation were imposed.
