7B_471/2024: Compensation after Termination of Criminal Proceedings

Summary of Facts

After the termination of various criminal proceedings, the public prosecutor awarded the complainant and her husband jointly compensation of 2,200 francs. The complainant's cantonal appeal was declared partially inadmissible due to lack of standing, whereupon she requested compensation of 5,400 francs for the preliminary proceedings before the Federal Supreme Court.

Summary of Considerations

(E.1) The contested decision is a partly final decision in a criminal matter. The complainant is entitled to allege formal denial of justice because the cantonal instance declared her appeal regarding compensation inadmissible; the appeal is otherwise timely and proper in form. At this procedural stage, the Federal Supreme Court only reviews the admissibility of the cantonal appeal. (E.2) Pursuant to Art. 382 para. 1 CPC, a party has a legally protected interest if it is directly and currently affected in its own rights; this applies in particular to the award of compensation. The subject matter of the dispute is determined by the contested points and must be interpreted based on the requests and their reasoning. The cantonal instance failed to recognize that the complainant had challenged the amount of compensation awarded to her in connection with the termination of the proceedings for defamation against her. By not deciding on this, it violated Art. 382 para. 1 CPC and committed a formal denial of justice. (E.3) The appeal is to be upheld. The contested decision is annulled to this extent and the matter is remitted for a new decision on compensation as well as the cantonal procedural costs and compensations. Court costs are not charged; the complainant is awarded party compensation.

Summary of the Dispositive

The appeal is upheld and the matter is remitted to the lower instance for a decision on the amount of compensation. No court costs are charged and a party compensation of 1,500 francs is awarded.

5A_942/2025: Edictal Service in Divorce Proceedings and Reopening of Proceedings

Summary of Facts

The complainant was summoned in the divorce proceedings by public notice after several address verifications had been unsuccessful. The divorce judgment became final. With a submission described as a reopening request/nullity action, she requested the declaration of nullity of various orders and the divorce judgment as well as the reopening of the divorce proceedings. The civil district court did not enter into the claim; the cantonal court dismissed the appeal. The complainant filed a civil law appeal against this decision.

Summary of Considerations

E.1: The civil law appeal is admissible; there is a final decision in a non-patrimonial civil matter, the complainant has standing, and the appeal was filed timely and properly. E.2: The Federal Supreme Court reviews legal violations under Art. 95 ff. FPC only if sufficiently substantiated and generally bases its assessment on the facts found by the lower instance. E.3: The lower instance based its decision on two independent lines of reasoning; both had to be challenged. E.4: Whether the non-entry due to insufficient legal claims withstands the prohibition of exaggerated formalism can remain open, as the complainant fails to refute the alternative argument. E.5: Edictal service under Art. 141 CPC is only permitted if other forms of service are impossible and all reasonable investigations have been unsuccessful. In the case of obviously impermissible public notice, a serious procedural defect and nullity may exist. E.6: The lower instance found that the respondent had unsuccessfully searched for the complainant’s address with several Swiss authorities and the Swiss Post. Given the separation lasting over 16 years, further investigations with family members, acquaintances, or an employer were not automatically necessary; service via legal assistance under the Hague Service Convention was also excluded. E.7: The complainant does not prove arbitrary factual findings. It is not established that the respondent knew her former address or a valid telephone number. Nor does she specify which concrete French authority could have been consulted or that the internet searches submitted then had the same content. According to the binding facts, her whereabouts were permanently unknown; further reasonable investigations were not indicated. The edictal service was therefore in accordance with federal law. E.8: The appeal is dismissed; the complainant bears the court costs and owes the respondent party compensation.

Summary of the Dispositive

The appeal is dismissed. The court costs are imposed on the complainant, who must pay the respondent party compensation of CHF 500.--.

5A_425/2026: Non-Entry on the Appeal Regarding Payment Orders

Summary of Facts

The complainant opposed several payment orders issued by the Debt Collection Office Bern-Mittelland in proceedings in the canton of Bern. The cantonal supervisory authority dismissed the appeal insofar as it entered into it. The complainant then filed an appeal to the Federal Supreme Court but died during the federal proceedings.

Summary of Considerations

E.1: Despite the complainant’s death, the proceedings are not stayed for procedural economy reasons, as the appeal is obviously insufficiently substantiated and thus ready for decision. E.2: The appeal reasoning must specifically state how the contested decision violates the law; for constitutional complaints, the strict complaint principle applies. E.3: The lower instance denied the nullity of the debt collection proceedings and the published payment orders. The electronic submission of the debt collection request and the conduct of the competent authority as the canton’s representative are admissible. E.4: The complainant’s general criticism of an earlier Federal Supreme Court decision and SECO publications does not demonstrate any legal violation. Claims for damages and compensation are not subject matter of the proceedings. E.5: The appeal is insufficiently substantiated and is therefore not entered into. Court costs are waived; the request for legal aid becomes moot.

Summary of the Dispositive

The appeal is not entered into. No court costs are charged.
