8C_615/2026: Non-admission of the appeal concerning waiver of reclaimed supplementary benefits
Summary of the facts
The Insurance Court of the Canton of St. Gallen confirmed the objection decision of the Social Insurance Institution of the Canton of St. Gallen, according to which the waiver of reclaimed supplementary benefits of CHF 43,267.47 is disregarded. The appellant filed an appeal with the Federal Supreme Court, claiming that he had neither intentionally nor negligently received the benefits.
Summary of the considerations
E.1: The appeal must contain requests and a concrete reasoning related to the relevant considerations of the contested decision. Mere repetition of one's own point of view or appellate criticism is not sufficient. E.2: The lower court denied good faith and therefore did not examine the cumulative waiver requirement of extreme hardship. E.3: The appellant did not show any obviously incorrect or otherwise unconstitutional finding of facts, violation of federal law, or other grounds for appeal. His arguments regarding the absence of intentional or negligent receipt and extreme hardship did not meet the requirements for reasoning. E.4: Due to the lack of sufficiently fact-related reasoning, the appeal is not admitted in the simplified procedure pursuant to Art. 108 para. 1 lit. b BGG. E.5: Exceptionally, court costs are waived; the request for legal aid thus becomes moot.
Summary of the dispositive
The appeal was not admitted. No court costs were charged; the request for legal aid thus became moot.
7B_1143/2026: Extension of pre-trial detention due to urgent suspicion of commercial arms trafficking
Summary of the facts
Since 2022, criminal proceedings have been conducted against A.________ for extensive drug and arms trafficking and other offenses. After his re-arrest in May 2024, numerous weapons, hand grenades, ammunition, and cash were seized. The regional coercive measures court extended the pre-trial detention until 18 August 2026; the indictment chamber of the Canton of St. Gallen dismissed the appeal against this. A.________ requests release from custody or alternative measures and the determination of a violation of the acceleration requirement.
Summary of the considerations
E.1: The criminal appeal is admissible; the appeal is admitted. E.2: Based on the investigation results, there is an urgent suspicion especially of commercial arms trafficking and endangerment of public safety with weapons. The detention court does not have to make a final assessment of evidence. E.3: The requirements for a simple risk of repetition according to Art. 221 para. 1 lit. c StPO are met. There are two relevant prior convictions, the threatened offenses seriously endanger the safety of others directly, and the relapse prognosis is unfavorable given the qualitative and quantitative escalation of the alleged delinquency. E.4: The pre-trial detention of about 34 months is proportionate considering the prospect of a long-term unconditional prison sentence. Suitable alternative measures to prevent the risk of repetition do not exist. E.5: No particularly serious violation of the acceleration requirement exists. The general duration of the preliminary proceedings is not to be examined in the detention proceedings. E.6: The appeal is dismissed; the court costs are to be imposed on the appellant.
Summary of the dispositive
The appeal is dismissed. The appellant is ordered to pay court costs of CHF 3,000.--.
5A_670/2026: Ownership of foals and conditions for emergency sale
Summary of the facts
The appellant demanded the return of three foals of which he claimed ownership, as well as the revocation of the seizure and the private emergency sale. The horses had been seized in the context of an additional seizure and were emergency sold due to the high maintenance and storage costs; two of the three affected foals died during the Federal Supreme Court proceedings.
Summary of the considerations
(E.1) The civil appeal is basically admissible. There is no current legitimate interest with regard to the foals that have since died; the question of a further claim for return can remain open. (E.2) The Federal Supreme Court only examines sufficiently substantiated complaints and is basically bound by the facts established by the lower court. The appellant's presentation of facts and evidentiary requests do not meet the requirements. (E.3) The complaint regarding inspection of files is insufficiently reasoned, as an application should first have been made to the debt collection office. (E.4) The conditions for the emergency sale under Art. 124 para. 2 SchKG were met due to disproportionately high maintenance and storage costs. The health condition of the horses was not decisive; a third-party claim was unknown to the debt collection office before the order for realization. (E.5) The Bernese supervisory authority was not competent for complaints regarding the modalities of the seizure ordered by legal assistance and the recording of third-party claims. The corresponding grounds for appeal also do not meet the requirements. (E.6) The appeal is dismissed insofar as it is admitted; the precautionary measures and the request for legal aid become moot. Court costs are waived.
Summary of the dispositive
The appeal was dismissed insofar as it was admitted. The request for precautionary measures was dismissed as moot, and no court costs were imposed.
