2C_580/2026: Non-admission of the complaint regarding international tax assistance
Summary of the facts
The German Central Liaison Office requested assistance from the Swiss Federal Tax Administration concerning B.________, who is allegedly subject to unlimited income tax liability in Germany due to at least one permanent residence. The FTA approved the assistance for the period from January 1, 2011, to December 31, 2024; the Federal Administrative Court rejected the complaint filed against this decision. The A.________ Foundation subsequently appealed to the Federal Supreme Court.
Summary of the considerations
(Para. 1) The Federal Supreme Court reviews its jurisdiction and the admissibility requirements ex officio. (Para. 1.1–1.1.2) Complaints in international tax assistance cases are only admissible if a legal question of fundamental importance is involved or if the case is of particular significance. (Para. 1.2–1.3.3) The raised question regarding the principle of international law trust has been answered by case law. Additional explanations are only required in cases of serious doubts about compliance with international law principles or the likely relevance; the concrete application concerns the individual case. Therefore, no legal question of fundamental importance is present. (Para. 1.4) The complainant does not demonstrate a qualified violation of fundamental procedural principles; no particularly significant case exists. (Para. 2) The complaint is not admitted. The court costs are imposed on the complainant; no party compensation is awarded.
Summary of the dispositive
The complaint in public-law matters was not admitted. The court costs of CHF 5,000.-- were imposed on the complainant; no party compensation was awarded.
7B_733/2026: Duty to provide reasons for orders on the authorization of telephone calls during detention
Summary of the facts
A.________ filed multiple applications for authorization to contact his son by telephone. The procedural management of the Criminal Appeals Chamber of the Vaud Cantonal Court rejected these applications with four orders, after which A.________ filed a criminal complaint with the Federal Supreme Court, requesting authorization for the telephone calls or, alternatively, the annulment and remittance of the case.
Summary of the considerations
(Para.1) The four proceedings concern identical orders, the same complaints, and the same legal requests; they are joined for reasons of procedural economy. (Para.2) The Federal Supreme Court reviews its jurisdiction and admissibility ex officio. (Para.2.1) The complaints are directed against appealable interlocutory orders in criminal matters, which may cause irreparable disadvantage and were decided by a cantonal instance. (Para.2.2) The complainant is entitled to complain, as he participated in the lower court proceedings, is in detention, and the disputed situation may recur. (Para.2.3) The complaints were filed timely and properly; they are admissible. (Para.3) The complaint concerns in particular the lack of reasoning and the form of the contested orders. (Para.3.1.1) The right to be heard requires that the decisive reasons be stated at least briefly, so that the affected person can understand the scope of the decision and challenge it appropriately. (Para.3.1.2) According to Art. 112 para. 1 lit. b BGG, appealable decisions must clearly state the relevant factual and legal reasons; if these requirements are violated, the Federal Supreme Court can annul and remit the case. (Para.3.2) The four orders consist essentially of a form with the rejection box checked; only the last order contains a handwritten reference to a letter. (Para.3.3) The orders contain neither the relevant factual nor legal reasons and thus violate Art. 112 BGG as well as Art. 29 para. 2 BV. The reference to a previous letter is insufficient as it does not contain an adequate factual basis for legal assessment. The absence of an instruction on appeal did not harm the complainant; the question of signatures can remain open. (Para.4) The complaints are upheld, the contested orders are annulled, and the cases are remitted for a new decision. No court costs are charged, party compensation is awarded to the complainant, and the requests for legal aid become moot.
Summary of the dispositive
The complaints were upheld and the contested orders annulled. The cases were remitted for a new decision; no court costs were charged, and party compensation was awarded.
5A_972/2026: Non-admission of the complaint regarding suspensive effect in wage garnishment
Summary of the facts
The Bern Cantonal Court did not grant suspensive effect in the cantonal appeal procedure against a wage garnishment. The complainant requested the Federal Supreme Court to annul this procedural order, grant suspensive effect, adjust the debt enforcement subsistence minimum for ongoing medical costs, and grant legal aid.
Summary of the considerations
Para.1: The request for substantive instruction to the debt enforcement office lies outside the possible subject of appeal. The order on suspensive effect is an interlocutory order and precautionary measure; its challenge requires the conditions of Art. 93 para. 1 BGG, and only constitutional rights may be asserted under a strict complaint principle. Para.2: The complainant limits himself to appellate remarks on Art. 93 SchKG and the costs to be considered in the subsistence minimum and does not allege violations of constitutional rights. Para.3: The complaint is manifestly insufficiently reasoned; it is not admissible in simplified proceedings. Para.4: Since the complaint could not succeed from the outset, the material requirements for legal aid are absent; the application is dismissed. Para.5: The court costs are to be imposed on the complainant.
Summary of the dispositive
The complaint is not admitted. The application for legal aid is dismissed and the court costs are imposed on the complainant.
