9C_542/2025: Calculation of Overcompensation and Reduction of an Invalidity Pension from Occupational Benefits

Summary of the Facts

The appellant received an invalidity pension from occupational benefits. After the accident insurance granted an annual invalidity pension in 2022, the pension fund recalculated an overcompensation and retroactively reduced the occupational benefits invalidity pension. The appellant challenged the incomes considered and the pension reduction with a new lawsuit, upon which the cantonal court did not enter due to res judicata.

Summary of the Considerations

(E.1) The cantonal court assumed that the 2024 lawsuit concerned the same dispute as the 2019 lawsuit; the decisive elements had been legally conclusively assessed through the dismissal of the earlier proceedings. (E.2) The appellant alleged an obviously incorrect determination of facts and asserted that the accident insurance pension was only taken into account in the later overcompensation calculation. (E.3) The Federal Supreme Court reviews the substantive res judicata freely. (E.3.1) The pension institution may reduce benefits in case of overcompensation and must adjust the calculation if circumstances change significantly; the decisive factor is the hypothetical income at the time of the overcompensation calculation. (E.3.2) In 2020, due to the absence of overcompensation, there was no legitimate interest in contesting the incomes then considered. Only through the additional accident insurance pension in 2022 was the occupational pension significantly reduced, thus creating a legitimate interest. (E.3.3) The earlier calculation was provisional because the accident insurance had not yet decided. The new lawsuit concerned, due to the new factual basis and necessary recalculation, no identical claim already legally conclusively assessed. (E.3.4) The cantonal court should have entered the lawsuit and examined all incomes relevant to the overcompensation calculation. The case is remanded for this purpose. (E.3.5) It also appears doubtful whether equality of arms would be preserved if a pension institution could unilaterally reduce an invalidity pension by means of a later overcompensation calculation without the insured person being able to legally challenge all calculation elements. (E.4) The losing respondent bears the court costs and must pay the appellant a party compensation.

Summary of the Dispositive

The appeal was upheld and the contested judgment annulled. The case was remanded to the lower court for examination of the relevant incomes and new assessment; the court costs and party compensation were imposed on the respondent.

6B_282/2026: Binding Nature of the Posted Speed Limit and Evidentiary Value of a Speed Measurement

Summary of the Facts

The appellant was accused of having driven at 82 km/h in a built-up area with a posted speed limit of 50 km/h after deduction of the tolerance. The Higher Court of the Canton of Graubünden sentenced him for gross violation of traffic rules to a conditional fine of 40 daily rates of CHF 150.-- and a fine of CHF 1,500.--. By criminal appeal, he requested the annulment of the judgment, the suspension of the criminal proceedings for administrative review of the signaling, and, alternatively, remand for reassessment.

Summary of the Considerations

(E.1) The criminal appeal is basically reformative; despite exclusively cassatory requests, the reasoning shows that the appellant seeks an acquittal. The appeal and arbitrariness complaints must satisfy the statutory requirements for justification; appellate criticism is not sufficient. (E.2) The lower court was not obliged to suspend the criminal proceedings. Posted speed limits are binding and must be observed for traffic safety reasons, even if their legality is disputed administratively. The signage was undisputedly posted at the time of the offense, no administrative proceedings had been initiated, and its validity was not to be reviewed in the criminal proceedings. (E.3) The factual findings and assessment of evidence of the lower court are not arbitrary. The automatically generated measurement protocol, the calibration certificate, the logbook, as well as the alignment and test pictures proved the perfect functionality of the measuring device and the correct measurement. The speed excess of 32 km/h was established; the legal assessment as gross violation of traffic rules and the sentencing were not challenged. (E.4) The appeal is to be dismissed to the extent it is admissible; the appellant bears the court costs.

Summary of the Dispositive

The appeal was dismissed to the extent it was admissible. The court costs of CHF 3,000.-- were imposed on the appellant.

5A_953/2026: Non-Admission of the Appeal Regarding Child Support Contributions

Summary of the Facts

The Civil Court of Basel-Stadt dissolved the marriage of the parties and placed the two children under the custody of the mother. It initially obliged the appellant to child support contributions of CHF 300 each. At the mother's lawsuit, it set the contributions higher retroactively and for the future. The Court of Appeal did not enter the appeal due to lack of reformative claims and lack of specified explanations in the appeal brief. The appellant essentially requests the Federal Supreme Court to set the contributions at CHF 300 each and to grant free legal aid.

Summary of the Considerations

E.1: Since the lower court did not enter the appeal, the Federal Supreme Court can basically only examine whether the non-admission decision was lawful. The appeal must engage substantively with the reasoning of the contested decision and demonstrate a violation of law under Art. 42 para. 2 BGG. E.2: The appellant alleges a violation of the right to be heard and exaggerated formalism but does not substantively engage with the reasoning that his appeal claims did not specify concrete maintenance contributions. He does not concretely show that specified appeal claims emerged from the appeal brief. Thus, he does not show any legal violation; also, specified claims are required for child support contributions. E.3: The appeal is manifestly insufficiently justified. It is not to be admitted under the simplified procedure according to Art. 108 para. 1 lit. b BGG. E.4: Since the appeal could not succeed from the outset, the material requirements for free legal aid are lacking; the request is to be dismissed. E.5: The court costs are imposed on the appellant.

Summary of the Dispositive

The appeal is not admitted. The request for free legal aid is dismissed and the court costs are imposed on the appellant.
