6F_31/2025: Request for Revision Regarding Acquittal for Murder
Summary of the Facts
The Public Prosecutor's Office of the Canton of Aargau requests the revision of a Federal Court judgment from March 29, 2018, which acquitted A.________ of the murder charge. The applicant relies on new facts and evidence from a criminal proceeding against A.________ in 2023, in which he allegedly committed threats and acts of violence and stated that he had already killed a person.
Summary of the Considerations
- **E.1:** Decisions of the Federal Court are final; a revision is only permissible in the presence of exhaustively regulated grounds for revision (Art. 121 ff. BGG). A revision due to new facts or evidence requires that these are significant and were unknown at the time of the original judgment. Facts and evidence must make the modification of the judgment at least probable. - **E.2:** The new facts and evidence presented by the applicant relate to events and statements of A.________ from 2023 and therefore to circumstances that arose only after the original judgment in 2018. They cannot be considered in terms of revision law. - **E.2.4:** Even if hypothetically examined, A.________'s statements to third parties in the context of violent incidents could not sufficiently seriously establish a connection to the perpetration in the murder case from 2012. The assessment of evidence from the original judgment remains valid and a release for revision is not justified.
Summary of the Dispositive Part
The request for revision is denied and no court costs are incurred.
