2C_683/2023: Judgment on Antitrust Sanction and Order in Connection with Swiss Ice Hockey Broadcasts on Pay-TV

Sunrise GmbH (formerly UPC Schweiz GmbH; Sunrise UPC GmbH) operated in the Swiss TV market and acquired exclusive broadcasting rights for Swiss ice hockey leagues in the summer of 2016. In 2017, it launched the sports channel "MySports", on which these rights were exploited. Swisscom and another company reported to the Competition Commission (WEKO) in 2017, alleging that Sunrise was unjustifiably refusing access to these ice hockey contents to other TV platforms. WEKO considered this an impermissible refusal of business relationships and imposed a sanction of nearly 30 million francs on Sunrise in 2020, ordering Sunrise to make the ice hockey offering accessible to other platforms without discrimination.
The Federal Administrative Court largely confirmed WEKO's assessment in 2023 but slightly reduced the sanction due to a shorter determined duration of the alleged antitrust violation. Sunrise subsequently appealed to the Federal Court.
