6B_375/2025: Ruling on Statute of Limitations and Evaluation of Evidence in a Sexual Criminal Proceedings

Summary of the Facts

In the present case, the appellant was convicted by the Cantonal Court of Lucerne for multiple sexual acts with a child. He received a prison sentence of 2 years and 5 months, imposed as an additional sentence to an earlier ruling. The appellant appealed this ruling, arguing that the offenses were time-barred and certain pieces of evidence that were supposed to prove his innocence were not considered.

Summary of the Considerations

In its considerations, the Federal Court states that the appellant did not fulfill the necessary burden of justification. There is a lack of engagement with the legal foundations regarding the statute of limitations and the considerations of the lower court. The appellant did not plausibly demonstrate why the lower court could have arbitrarily established the facts, especially since the offense of sexual acts with children constitutes an official crime. As a result, the appeal was deemed unfounded.

Summary of the Disposition

The appeal was dismissed due to lack of suitable justification, and the court costs were imposed on the appellant.
